A recent Screen Australia report determined only 5 per cent of characters in Australian TV dramas could be identified as LGBTQI; less than half the proportion of real-world queer individuals in Australia. Media products are inherently normative, legitimising identities and lived realities through visibility. This is important, given the continuing debates surrounding marriage equality and the pervasiveness of homophobia, the result of which was seen in the suicide of 13-year-old Tyrone Unsworth.
When the dust settles next year, maybe LGBTI advocates will see the wisdom in trying to convince the Labor party to reinstitute a free conscience vote on its side if only to force the Coalition to do the same. That way the parliament a few years down the track might be able to do what the LGBTI advocates want them to do now. If it were my call, I would have opted for the plebiscite in February with prompt parliamentary legislation to follow. But it's not my call.
Marriage, and more broadly any other close domestic relationship, is a fundamental social institution. Could not the federal legislation move away from defining marriage to a regime where it recognises marriage? It could recognise Catholic marriage (as described in the Code of Canon Law). It could recognise Anglican or Jewish or Islamic marriage and it could recognise secular marriage (which could include a same sex relationship). On this basis the various 'marriages' are different but equal.
Once Turnbull went to the election with a commitment not to legislate for same sex marriage except after the conduct of a successful plebiscite, it was inevitable that the only way forward to resolving the issue during the life of this parliament would be by enacting legislation to authorise a plebiscite. A conscience vote during the life of this parliament, and without a plebiscite, would leave the opponents of same sex marriage rightly feeling that the government had breached an election commitment.
When a traditional marriage breaks down, there is a substantial body of law that has been developed to deal with the consequences. A substantial number of people in the community have already entered into homosexual relationships, monogamous and intended to be permanent. Some will break down, and disputes will arise about matters such as property, maintenance, and access to children. Common law principles are inadequate for settling such disputes fairly and economically.
If the plebiscite bill is defeated in parliament Labor, the Greens and Nick Xenophon will bear responsibility for not taking the opportunity offered even if it is in their view a second-best option. The government is already labelling them as same sex marriage wreckers. Yet if before too long a parliamentary alternative, such as a free vote, is found to advance the cause of same sex marriage then the rejection of the plebiscite option will come to be applauded as a master stroke.
If you're a cisgender straight person, the Irish vote 'no' poster, like 'Children need a mother and father', may not seem like a big deal. You may even agree with it. However, if you're a LGBTI young person who might be going through a process of denial and self-loathing about your sexual orientation or gender identity, it's just another reminder in your daily life that there are people who think you are wrong for being who you are. It's a sign that says you're not welcome or wanted here.
As Pope Francis was releasing his long-awaited response to last year's Synod on the Family, my fiancé and I were taking part in a marriage preparation course, where we were told: 'Statistics tell us that one in three of your marriages will end in divorce ... while only a third of you will have a happy marriage.' If love is a type of craftsmanship, as Francis writes, then our hope is that day to day, with small and large acts of love, we can help each other become masters of our craft.
At the moment, the conversation on marriage equality vs traditional marriage is being driven by extremists on both sides, people who see the struggle as a polarised conflict with the goal of overwhelming victory. But most of us would find that victory unattractive no matter which side is triumphant. Instead, we can choose not to press the button, and to work together to allow both same-sex couples and practising Christians to live their beliefs faithfully, to the fullest of their flourishing.
Although important to respond to generously, divorced and homosexual Catholics will not be the only people who make a claim on the Synod on the Family in Rome, with bishops of the Third World to want a focus on the life and death issues that face families in their region. But divorced and homosexual Catholics are important, and the divisions between bishops are both real, and generally misread by the media.
Traditional marriage is on very shaky ground because we are continually trying to extract equality out of inequality. While parenting and housework are the essence of family life, her caring work within the home is not considered of primary value. Feminism confronts not only sexism but also racism and classism, indeed, the interweaving of all forms of oppression. Marriage changes its shape as we change our culture — and we are.
